The Constitutional Right to Material Assistance of Chinese Peasants:A Case Study of the Rural Endowment Insurance

Senior citizens have the constitutional right to material assistance from the state and society,but China's legal system of the rural endowment insurance drops behind and infringes upon the aged peasants' rights.About sixty percent of the Chinese senior citizens live in the countryside,so it is paramount to guarantee their rights and interests.Moreover,the 17th CPC National Congress emphasizes the improvement of the system and the livelihood.This paper deals with the actualities,the international conventions,and the legislations concerned at home and abroad.Some legislative proposals are put forward to promote the rural endowment insurance.
