Percepciones de los actores claves sobre el proceso judicial penal asociado a delitos de Explotación Sexual Comercial de Niños, Niñas y Adolescentes en la comuna de Concepción, Chile

Esta investigacion busco conocer las percepciones que tienen algunos actores claves sobre el proceso judicial penal asociado a delitos de Explotacion Sexual Comercial de Ninos, Ninas y Adolescentes (ESCNNA) en la comuna de Concepcion, Chile. Con el fin de identificar aspectos concretos del proceso y los nudos criticos que se desprenden de los procedimientos que acompanan la judicializacion de la ESCNNA. Se realizaron catorce entrevistas a profesionales que producto de sus funciones participan del proceso judicial en sus diferentes etapas. El estudio es de tipo cualitativo y el metodo de analisis utilizado fue el de contenido, ello permitio responder ?Como perciben el proceso judicial penal asociado a la ESCNNA, los actores que intervienen en el mismo, en la circunscripcion de la comuna de Concepcion?. Advirtiendose que los funcionarios y profesionales, si bien perciben que el proceso judicial penal a evolucionado positivamente, ello aun sigue siendo insuficiente en relacion a la reivindicacion de derechos y reparacion integral de las victimas, que la judicializacion es clave para la significacion del dano, que los profesionales y funcionarios requieren mas especializacion, que el Estado debe procurar la penalizacion efectiva de cada modalidad de la ESCNNA, y que en los sistemas aun persisten visiones adultistas, machistas, patriarcales, y desiguales que vulneran fuertemente a las NNA en situacion de ESC. This research intends to know the perceptions of some key players on the criminal justice process associated with crimes of Commercial Sexual Exploitation of Children (CSEC) in the town of Concepcion, Chile. In order to identify specific aspects of the process and the critical problems arising from the procedures that accompany the prosecution of CSEC. Fourteen interviews were conducted to same number of professionals involved through out their functions in various stages of the judicial process. The study is qualitative and the method used for the analysis was the one based in the content, this helped answering How the actors involved perceived the criminal justice process associated with CSEC, in the district of the town of Conception?. Being noticeable that officials and professionals, while seeing that the criminal justice process has evolved positively, it is still inadequate in relation to the assertion of rights and reparation for victims, that the prosecution is key to the significance of the damage, and also that the professionals and officials require more specialization, that the State must ensure the effective penalties for each type of CSEC, and that in the system still persist adult visions, sexist, patriarchal that are unequally and strongly violate children and adolescents in CSEC situation.
