In order to examine the possibility of the rule of law as a strategy to improve human rights in North Korea, it is necessary to systematically review and derive implications from the context and theory behind the emergence of the support for the rule of law as well as its existing practices. Therefore, this paper will examine the correlation among relevant theories concerning the rule of law, democracy, and human rights improvement, and then analyze specific cases of international organization and states’ promotion of the rule of law. In order to derive implications for the case of North Korea, this paper will focus on the international community’s support for the rule of law in regions including China, Mongolia, Vietnam, etc. In order to explore the meaning of the rule of law, the paper will review how relevant actors have been promoting it, and then analyze the commonalities and differences among different actors’ support for the rule of law. Furthermore, the paper will review what political, economic, and social environment will allow the rule of law to flourish. Then it will analyze the main factors which have led to its success or failure. Based on such analysis, the paper will examine the possibility of supporting the rule of law in North Korea and present measures for implementation. Moreover, it will shed light on how North Korea has responded to the international community’s human rights related technical assistance, and analyze in detail the possibility of North Korea’s acceptance of the rule of law as one mean of human rights technical cooperation. Based on such analysis, the paper will review measures to improve North Korea’s possibility for acceptance. It seeks to present basic principles and specific content to promote North Korea’s support for the rule of law. This research is academically meaningful in that it provides a theoretical investigation of the correlation between the rule of law, which has been utilized as a key strategy for human rights improvement, and the promotion of human rights. The international community has shown keen interest in North Korea’s support for the rule of law and as such it is necessary for the South Korean government to take on an active role on the issue. Therefore, this research can be utilized as a useful policy resource in specifying the South Korean government’s policy implementation measures.
