A RESPONSABILIDADE CIVIL OBJETIVA E SOLIDÁRIA ENTRE A INSTITUIÇÃO DE ENSINO E A FAMÍLIA NOS CASOS DE BULLYING ESCOLAR

Resumo: O presente artigo se enraiza na necessidade de minimizar os danos causados pelo bullying estudantil, atraves da responsabilizacao civil, contudo, nao basta indenizar a vitima, vez que o carater pedagogico de tal responsabilizacao deve ser intrinseco. Deste modo, maior impacto social a responsabilizacao civil tera se for objetiva e solidaria entre familia e escola nos casos de bullying escolar, visto que colaborara para uma mudanca de paradigma, devolvendo a familia o poder/dever de bem educar suas criancas para o convivio social saudavel ao inves de reforcar, erroneamente, a comodidade de deixar a instituicao de ensino tal atribuicao. Nesse diapasao, o artigo em tela se propoe a analisar a viabilidade da responsabilizacao civil objetiva e solidaria da familia e da escola, pelos danos do bullying escolar praticado por um infanto nas dependencias da instituicao de ensino, e sua aplicabilidade no ordenamento juridico brasileiro. THE STRICT LIABILITY AND SOLIDARITY BETWEEN THE EDUCATIONAL INSTITUTION AND FAMILY IN SCHOOL BULLYING CASES Abstract: This article is rooted in the need to minimize the harm caused by bullying student, through civil liability, however, is not enough to compensate the victim, rather than the pedagogical nature of such accountability should be intrinsic. Thus, greater social impact to civil liability will be for objective and solidarity between family and school in cases of school bullying, as it will work for a paradigm shift, returning to the family's power / duty to educate their children well for socializing healthy rather than erroneously reinforce the convenience of leaving the educational institution such assignment. In this vein, the article proposes the screen to analyze the feasibility of objective and supportive civil liability of the family and school, the damage of school bullying practiced by children on the premises of the educational institution, and its applicability in the Brazilian legal system.
