Fashion Law: The New Trend between Criminal and Economic Law (A Brazilian Perspective)

This essay debates the new emerging trends of Fashion Law in Brazil, addressing the need for a more realistic assessment of the domestic regulatory model. It is structured as follows: (1) theoretical discussion of the social theory of fashion and its possible consequences to Fashion Law; (2) criticisms on the criminal protection of intellectual property and counterfeiting in Brazil; (3) comparative discussion about recent international and domestic cases on regulatory fashion law; (4) the need to reshape both Brazilian´s responsive and regulatory framework towards a better understanding of Fashion Law. The aim is to articulate the thought-provoking moral and economic questions and challenges faced by the interaction between Criminal and Economic Law.
