UCITA and Fair Use: A Compatible or Combatable Relationship

The Uniform Computer Information Transactions Act (UCITA) is a proposed state law that seeks to create a uniform approach to software and information licensing. Sarah K. Wiant, Director of the Law Library at Washington and Lee University in Virginia, briefly outlined the history of the construction of this act, its controversial passage in Virginia and Maryland, and its current status in other state legislatures. She explained language flaws, conflicts with federal law, and unusual prohibitions, which clearly endanger circulation, interlibrary loan, scholarly research and publication, and other normal library activities associated with digital resources.
