A tutela dos créditos laborais no caso de transmissão de unidade económica: breves notas sobre a evolução recente

This study seeks to contribute on a brief reflection about the overview of the joint and several liability regime between transferor and transferee for labour credits, particularly in the transfer of undertaking context. This sui generis legal regime, has been constantly adjusted by the Portuguese Labour Law, consequently generating a wide doctrinal debate which has an impacts on the jurisprudential responses. To a better understanding of the regime, this paper will focus on its essentials traces, through its normative evolution, since the pre-code legislation until the Law n.o 14/2018, 19th of March.
