La prescripción de la acción de indemnización de daños en caso de abusos sexuales a menores

espanolLa prescripcion de la accion de indemnizacion de danos por abusos sexuales a menores presenta unos perfiles propios, sobre todo en lo que concierne al inicio del plazo de prescripcion. En este trabajo se explican las razones por las que no corre el plazo de prescripcion si el danado no tiene la posibilidad juridica de ejercitar la accion indemnizatoria y la posibilidad real de hacerlo, por concurrir fuerza mayor o algun impedimento psiquico que le impide reclamar. Tambien se aclara que hechos tiene que conocer el menor danado (o su representante legal) para que empiece a correr el plazo prescriptivo, y las dificultades que plantea el hecho de que, a veces, los danos se manifiesten mucho tiempo despues de producido el abuso sexual. EnglishThe prescription of the action for compensation of damages for sexual abuse of minors presents its own profiles, especially in what concerns the beginning of the statute of limitations. This paper explains the reasons why the statute of limitations does not run if the injured person does not have the legal possibility of exercising the compensation action and the real possibility of doing so, due to force majeure or some mental impediment that prevents him from claiming. It also clarifies what facts the injured minor (or his legal representative) must know in order for the statute of limitations to run, and the difficulties posed by the fact that, sometimes, the damage manifests itself long after the sexual abuse has occurred.
