Maternidad en legislación mexicana: Una visión desde los derechos laborales de la mujer

espanolLa maternidad segura, la atencion de salud a la madre y la supervivencia del recien nacido son parte esencial de la vida, ademas de fundamentales para el entorno laboral y la productividad de las mujeres. Por lo que, la proteccion de la maternidad es un derecho laboral que ha quedado estipulado en tratados universales de los derechos humanos y como resultado, en casi todos los paises del mundo se han promulgado leyes sobre proteccion a la maternidad en el trabajo. El objetivo de este articulo consiste en realizar una revision bibliografica para conocer y analizar las principales disposiciones juridicas de la legislacion en materia de proteccion de la maternidad en Mexico. En este articulo documental, el metodo empleado se centro en la revision de diversas bases de datos (Scopus, Redalyc, Scielo y Web of Sciencie). Como resultado se obtuvo que en los ultimos veinte anos se han realizado mejoras en las leyes que protegen la maternidad, asignando periodos mas prolongados de descanso durante el postparto. Se concluye, que en Mexico a pesar de estos avances, en algunas ocasiones puede no ser suficiente para permitir el crecimiento adecuado de la mujer en el contexto laboral y en su realizacion como madre. Therefore, maternity protection is a labor law that has been stipulated in universal human rights treaties and as a result, laws on maternity protection at work have been enacted in almost every country in the world. The objective of this article is to conduct a bibliographic review to know and analyze the main legal provisions of the maternity protection legislation in Mexico. In this documentary article, the method used focused on the review of various databases (Scopus, Redalyc, Scielo and Web of Sciencie). As a result, it was obtained that in the last twenty years improvements have been made in the laws that protect maternity, assigning longer periods of rest during postpartum. It is concluded that in Mexico, despite these advances, sometimes it may not be enough to allow the adequate growth of women in the work context and in their realization as a mother.
