Interpretation: A Model of Legal Adaptation to Social Change

Interpretation of laws and regulations is common in legal processes and practices, especially criminal law, in a very dynamic and fast-moving society. This research tries to reveal exposure to various legal practice interpretations in Indonesia and their multiple problems. This study uses a qualitative approach with descriptive methods to provide an overview of legal practice interpretation and existing problems. The study results reveal the problematic interpretation of the law used in adapting social changes that occur in society, as seen from cases that arise in the world of justice. On the one hand, the positivist view seeks to maintain legal certainty as a reference in acting. Still, on the other hand, this view is deemed unable to keep pace with society's development. Legal interpretation is considered a reasonable effort to provide legal certainty in social change. It is hoped that this research can provide an overview of the importance of the method of interpretation in applying the law and the development of criminal law in the future.
