Uso de algemas e abuso de autoridade – Comentários ao projeto de lei 7659/2017

A utilizacao de algemas, atualmente regulamentada pela Sumula Vinculante no 11/2008 do STF e pelo Decreto 8858/16 , foi materia do artigo 17 do projeto de lei PL 7.569/2017, aprovado em 14 de agosto de 2019 pela Câmara dos Deputados. O Projeto de lei ainda depende de sansao presidencial, mas trata de um assunto polemico: abuso de autoridade. A proposta preve, no artigo 17, pena de seis meses a dois anos de detencao para casos nos quais a autoridade submeter o preso ao uso de algemas quando estiver claro que nao ha resistencia a prisao, ameaca de fuga ou risco a integridade fisica do preso. Diante desse cenario o presente artigo visa discutir tal artigo a partir de uma construcao historica social do uso de algemas, observando as leis que ja tratam sobre assunto, o Codigo de Processo Penal, os principios fundamentais e a Seguranca Publica, como interesse coletivo prevalecendo sobre os interesses individuais. The use of handcuffs, currently regulated by STF Binding Precedent No. 11/2008 and Decree 8858/16, was the subject of article 17 of Bill PL 7.569 / 2017, approved on August 14, 2019 by the House of Representatives. The Bill still depends on presidential Samson, but it deals with a controversial issue: abuse of authority. The proposal provides, in article 17, for a period of six months to two years imprisonment for cases in which the authority subjects the prisoner to the use of handcuffs when it is clear that there is no resistance to arrest, threat of escape or risk to the physical integrity of the prisoner. . Given this scenario, this article aims to discuss this article from a historical social construction of the use of handcuffs, observing the laws that already deal with the subject, the Code of Criminal Procedure, the fundamental principles and Public Security, as a collective interest prevailing over individual interests.
