Stay orders under the child support legislation
2012
Under section 111C of the Child Support (Registration and Collection) Act 1988 (Cth) ('the Registration and Collection Act'), a court can make an order which stays or otherwise affects the operation or implementation of the Child Support (Assessment) Act 1989 (Cth) ('the Assessment Act') and/or the Registration and Collection Act. A stay order can be made if certain proceedings under the Assessment Act or Registration and Collection Act are on foot, and will operate for such period specified by the court or until the proceedings become final.
