2020
Analysis of Human Rights for Lesbian, Gay, Bisexual, Trangender (LGBT) groups refers to Law no. 39 of 1999 on Human Rights, Law no. 1 on Marriage, UDHR and ICCPR. The first resolution on the recognition of LGBT rights was issued by the UN Human Rights Council in 2011. The formulations of the problems are: 1. What is the Position of LGBT Human Rights in an International Legal Perspective? 2. What is the Position of LGBT Human Rights in the Perspective of Indonesian National Law? 3. What is the current position of LGBT in Indonesia? This type of research is normative juridical research, namely research that examines the study of documents, namely using various secondary data such as statutory regulations, court decisions, legal theory, and can be in the form of opinions of scholars. The data source of this research is only secondary data, including official documents, books, research results in the form of reports, and so on. Data collection techniques are carried out by means of library research (Library Research), which is research conducted by examining library materials or what is called secondary data. Writing This Thesis Using Data Analysis Technique Descriptive Method. Descriptive method is by describing what it is about a legal event or applicable legal conditions. The provisions of international law on human rights from LGBT groups still refer to general provisions on human rights in international human rights instruments such as the UDHR and ICCPR. International legal instruments regulating LGBT issues only explicitly discuss the position of LGBT, but are specifically not regulated. National legal arrangements for the position of LGBT people in Indonesia are also not specifically regulated. However, fundamentally LGBT is against the Marriage Law and Pancasila.
