Employer Control of Private Life: the Karst Topography of U.S. Law

In the United States the legal insulation of an employee’s private and family life from employer control lies in small pockets of protection, sometimes exceedingly technical, on a terrain of otherwise plenary employer power. This article tours that legal terrain. It attempts an historical explanation for how this has come about, on why the U.S. differs so strongly from Europe.
