Legitimidade da atuação criminal do ministério público do trabalho como meio eficaz de proteção da saúde do trabalhador: responsabilização criminal do médico do trabalho

This article deals with the legitimacy of the criminal actions of the Public Labor Ministry in environmental protection work and ensuring respect for the dignity of the human person. In this context, reflects about the genocide of the working class in the face of inhuman levels of occupational accidents and occupational diseases. Approaches the middle of the work environment and the fundamental rights of the citizen-worker, based on legislation and doctrine. We sought to study channel with a questioning look on doctrines dedicated to topics arranged in a literary interdisciplinary dialogue, with the work The Strange case of Dr. Jekyll and Mr. Hyde, pointing out the similarities with medical contours of today's work, which aims defend the company's financial health in damage workers' health. That said, sees the innovative topic of discussion, by the labor branch of the prosecution, as the criminal liability of the occupational physician and the clinical partner of occupational medicine which, by fraud or negligence, are causing work-related injury or occupational disease. It was necessary to investigate the legitimacy of the Ministry of Labor in the criminal realm and its applicability in these cases, with the protagonist the worker. Finally, after proving the criminal award of the Ministry of Labor, was intended to demonstrate the urgent maximizing the performance of the labor parquet in defense of the work environment. It is characterized as a theoretical and documentary research, in a doctrinal and legal perspective, applied as a script.
