Compensation of damages for killing or injury of a pet
2015
The goal of this paper is to consider the legal options of an owner to obtain a recovery from a person who caused the death of the pet, which exceeds the market value of the pet in the case the pet is killed. It is a fact that crossbred, even purebred pets, have a low or no market value. In order to even consider the damage, there must be a loss in somebody's assets. However, if the matter is about an animal that has no market value, does that mean that the killing of such an animal does not represent the damage for its owner? A confirmative answer to this question fits into the traditional civil law concept, although it is deeply unjust. Firstly, this article describes legal status of animals in civil law, and then sets forth the compensatory damage in case of killing or injury of the pet. The main part of the paper examines the legal possibility to recover the damages in order to compensate special affection that exists between the owner and the pet.
