The present essay analizes the beginning of the distinction between exchange and the contract of sale in Rome, the opinion of two famous law schools belonging to the first century a.D: the sabinians and the proculians, the solution sustained by the Corpus Iuris Civilis, and the way it was recepted by Dalmacio Velez Sarsfield in the Argentine Civil Code, and in some Latinoamerican and European Civil codes.
