DETERMINING THE JURISDICTION ON THE CASE WITH A FOREIGN ELEMENT

The article discusses the general rules for determining international jurisdiction. These rules are very diverse, but they can be reduced to some typical cases, highlighting: Latin (by type of citizenship / plaintiff), German (by place of residence, by types) / Anglo-Saxon (by factual presence) jurisdiction system. Considering that states use different approaches and criteria for determining the competence of their own courts to handle cases with a foreign element, this can lead to competition and conflict of jurisdiction when it is cognizable by the courts of several states at the same time. Therefore, the question of jurisdiction of cases is decided by states on the basis of multi-and bilateral agreements.
