Across the world, indigenous peoples are asserting their rights to be involved in decisions about energy and resource projects that impact on their traditional lands and waters. This chapter provides an initial overview of international law principles, before turning to detail two case studies of agreement making with indigenous communities, governed by the Australian Native Title Act 1993 (CTH).
