O PARADIGMA NO DIREITO DE AMAMENTAR NO BRASIL

RESUMO : O aleitamento materno e fundamental no primeiro semestre de vida da crianca para o seu crescimento e desenvolvimento saudavel, visto que, ate os seis meses de vida, a dieta deve ser restrita a este nutriente, caso contrario, a crianca estara mais propensa a doencas e, consequentemente, a morte. Nesse contexto, e plausivel investigar os aspectos politicos e epistemologicos que subsidiam o direito de amamentar no Brasil a partir da nocao de paradigma. O objetivo deste estudo e delinear os incentivos do Estado para o aleitamento materno e o distanciamento entre o que e preconizado e a realidade da mulher-mae-trabalhadora. Trata-se de um artigo de reflexao. Nos dias atuais, o pais tem uma legislacao avancada no sentido da protecao e promocao do ato de amamentar, contudo, nao e suficiente para o cumprimento do que e preconizado pela Organizacao Mundial da Saude. Observa-se que desde as primeiras leis de 1943 e da constituicao federal de 1988 houve evolucoes no âmbito legal de garantia e extensao do direito a amamentacao, contudo e ainda necessaria a efetivacao de propostas em trâmite para a garantia legal deste direito. Maior divulgacao e fiscalizacao da implementacao das leis alem do fortalecimento de programas de incentivo a amamentacao,  sao estrategias necessarias para a consolidacao de uma mudanca paradigmatica que estabeleca a amamentacao exclusiva ate o sexto mes de vida como pratica dominante. ABSTRACT: Breastfeeding is fundamental in the first six months of a baby’s life for proper growth and development, which means that up to six months, the diet should be restricted to this nutrient otherwise the child will be prone to diseases and consequently infant death. In this context, it is possible to investigate the political and epistemological aspects that support the right to breastfeed in Brazil from a paradigmatic perspective. The objective of this study is to outline the incentives provided by the state for breastfeeding and the gap between medical recommendation and the reality of working mothers. This is a reflection article. Brazil has an advanced legislation on the protection and promotion of breastfeeding, however, is not sufficient to follow the recommendation of the World Health Organization. Since the first laws on the subject, in 1943 and the Federal Constitution of 1988, there were improvements in the legal assurance and extension of the right to breastfeed, nonetheless the implementation of new proposals still in debate is still necessary to guarantee this legal right. Better dissemination and law enforcement, besides strengthening of breastfeeding encouragement programs are vital to the consolidation of a paradigm shift, which establishes exclusive breastfeeding up to the sixth month a standard.
