This article analyses the employment safeguard clause regulated in the sixth additional provision of Royal Decree-Law 8/2020, of 17 March, on extraordinary urgent measures to address the economic and social impact of COVID-19, the scope of which has given rise to different interpretations in the doctrine and in labor courts, with particular challenges in determining whether the effects of non-compliance with the commitment affect the legal qualification of the termination of the employment contract that implies a breach of the legal mandate.
