The Business Method Innovation of Chinese Banking and its Patent Protection

Beginning with defining the concepts related to business method innovation and introducing the development history of business method patent in the banking, this paper carries out a thorough retrieval on Chinese banking’s business method patent and then makes an in-depth analysis on its development status. After China’s entrance into the WTO, business method patent has become one of the edges of foreign-funded banks to make competition on Chinese financial market. The paper concludes that although Chinese banks have improved their patent protection awareness and patent management, they still do not possess the advantages in the field of business method patent and require more time before carrying out patent strategies. Therefore, Chinese banks have to make further steps to enhance their business method patent’s technical content, speed up the patent research in the core technical field and pay close attention to those patent technologies in developed countries’ banking.
