Danno biologico persistente: il presupposto dottrinale

2013
[Persistent biological damage: the doctrinal assumption] At present the medical-legal doctrine and jurisprudence do not consider as separate items forms or types of biological damage intermediate between the temporary disability and the permanent disability, or all those temporal categories of psychological and physical harm to the person that improve up to regress completely in time, after their stabilization to healing of the disease. Our study group named those items with the term of "Persistent biological damage properly said". The purpose of this work is to increase awareness of specialists and experts in the biological damage, as well as scientific institutions and industry regulatory bodies competent to assess the fairness and reasonableness of the persistent biological damage as a new term in the assessment of psychological and physical harm to the person, since its existence is indisputable real and effective, both theoretical and practical. The path to greater clarity and methodological correctness of persistent biological damage must necessarily start from the knowledge of its definitional aspects, that is illustrated in the first part of the work, and then passed on the guidelines that describe the clinical, forensic and legal issues.
