SEPA-Lastschrift und Valutaverhältnis: Zivilrechtliche Fragen von Erstattung und Widerruf

The SEPA direct debit scheme is an important way to effect payments in practice. Since the use of direct debits is associated with certain risks for the payer, the law of payment services provides the option to withdraw the consent to execute the payment transaction. Moreover, the payer has, in principle, the right to a refund after a payment is executed. While detailed rules exist on the relationship between the payment service provider and the payment service user, many aspects of the relationship between the payer and the payee remain unclear. The present article focuses on this relationship and explores it from a civil law perspective.
