Analysis on the Feasibility of Three-tiered System in Capital Cases

The Supreme People’s Court has taken the authority of reviewing capital cases back to itself to exercise unified, it makes the review procedure of death penalty standard and perfect gradually. However, the approach has only solved the problem of attribution, so we should change the review procedure of death penalty into one kind of opening legal procedure completely,namely,three-tiered system, so as to enable three-tiered to display its effectiveness truly as the last defense to guarantee the death penalty applied correctly. Our country has possessed the material foundation,the social foundation and the idea foundation to construct the three-tiered system, so we should carry on the radical reform.
