Land for development located near railway stations are often a scarce resource, combined with the fact that there is large economical potential when the land is used in an ideal way there should be a societal interest in the land being used efficiently. In Sweden the municipalities have a monopoly on controlling land use with detailed development plans. A government in-quiry was appointed to investigate the planning process and pointed out a problem with unnec-essary levels of detail in the plans. None of their legislative suggestions have yet been passed so there is an indication that planning isn’t done in a socially efficient way. The purpose of this theses is to develop an assessment model for analyzing efficiency under regulation. With the previously mentioned problem the purpose is to use the model to evaluate how efficient provisions of development are used in detailed development plans near railway stations. The goal is not to present alternatives for new, more efficient, regulation but to exam-ine and illustrate the efficiency in today’s system. In the first part of the study the assessment model is developed using planning legislation and economic theory. The model is founded on division into categories based on situations where regulation theoretically could lead to an efficient outcome. The assessment is done based on the planning documents from the selected plans. Thirty detailed development plans from the, by population, largest municipalities in Sweden 624 provisions have been categorized. The out-come of the study shows a pattern that interprets as there being considerable possibilities for the individual planner to plan according to his own preferences as a result of control and incentive problems. To further analyze the outcomes of the first part of the study to fulfil the purpose a method of law and economics is used. Representative provisions of development have been analyzed with the Coase theorem to evaluate whether the regulation leads to an efficient outcome or not. In this part of the study, two of the six analyzed provisions were assessed not to lead to an effi-cient outcome. The developed model is a part of the results from the thesis and are hoped to contribute to fur-ther analysis within the field. The outcomes of the study indicate there is a lack in efficiency when it comes to the use of provisions of development in detailed development plans.
