The Law and Lore of the Australian Civil Jury and Civil Jury System

A basic premise when removing the rights of citizens, is that the loss of those rights is outweighed by the proven need for reform. This article will highlight how widespread and undesirable law reform based on anecdote in Australia is. Reasons for the lack of understanding of our civil justice system will be identified. The article will also argue for more empirical research upon which informed proposals for the reform of the Australian civil justice system can be based.
