Reparation for Victims

This chapter looks at the reparation process for victims in greater detail. It addresses the general issue of reparation from three perspectives, namely the responsibility of the international community to provide reparations, the state responsibility to foresee reparation, and individual responsibility regarding reparations. Historical examples of international reparations practice taking into account interstate and national reparations are presented. In addition, it describes the legal framework and the established case law of the reparations system at the International Criminal Court. This chapter looks at the involvement of victims in the reparation phase and the role of the Trust Fund for Victims in the reparation process at the International Criminal Court. It also introduces into the Trust Fund for Victims system and quarrels with the funds raised for reparations. The chapter concludes with the critical enforcement and implementation plan of the reparation awards.
