DEL SILENCIO ADMINISTRATIVO POSITIVO EN LA CONTRATACIÓN PÚBLICA: UN ESTUDIO SOBRE LOS ASPECTOS MATERIALES PARA SU VALIDEZ Y EFICACIA.

This article contains an analysis of the figure of the positive response regarding the new regulation introduced by Law 1437 of 2011 over the repealed Decree 01 of 1984 to include a requirement of effectiveness of the apparent positive act notarization thereof. Some aspects related to the elements of the administrative act or alleged competition notional administration will be analyzed and then decide the term of up to respond. With this understanding, it is essential first step in reference to those factors in the general administrative act, to later delve into its operation in the notional administrative act, due to the positive administrative silence.
