El derecho humano al agua en Colombia: una mirada desde su reconocimiento jurídico en la gestión de cuencas hidrográficas

The human right to water should contribute to changing the management and governance of water, particularly in the Colombian context due to the vulnerability to climate change and the high rates of poverty and violence. Facing these issues, academics and social movements have proposed new ways of addressing the content and scope of the human right to water, ranging from its collective and common nature to the democratization of water management and reflections on the rights of nature. The main objective of this article is to characterize some of these new approaches to the human right to water, and also analyzing their recognition and guarantee in the Colombian legal system. According to this, a normative content that allows this right to be integrated in the management of watersheds is proposed. The conclusions highlight the importance of recognizing the human right to water in the management of watersheds, based on the criteria of governance, governability and sovereignty.
