La prohibición de indultar a los corruptos: ¿Medida con valor real o aparente?

espanolEn la lucha contra la corrupcion la institucion del indulto se nos presenta como un u l- timo aliado de aquellos sujetos que, abusando de su posicion, orientan la prestacion de se r- vicio publico a su propio beneficio. El control y la limitacion sobre la concesion de los i n- dultos se revela como u n elemento clave a la hora de luchar no solo contra la corrupcion en si misma, sino contra la percepcion de la misma por parte de la ciudadania. Para testar la viabilidad de la prohibicion sera necesario analizar brevemente la institucion del indulto y determinar a que delitos nos referimos cuando hablamos de corrupcion. De este analisis d e- duciremos los limites y posibilidades de la prohibicion ex presa, para asi poder valorar los argumentos a favor y en contra de la misma, asi como las alternativas actuales que pudieran alcanzar los objetivos pretendidos. EnglishIn the fight against corruption the institution of pardon is presented as a last ally of those subjects who, abusing their position, orient the provision of public service to their own benefit. Control and limitation on the granting of pardons is revealed as a key element in fighting, not only against corruption in itself , but against the perception of it by the citizens. To test the viability of the ban, it will be necessary to briefly analyze the pardon institution and determine what crimes we refer when we speak of corruption. From this analysis we will deduce the limits and possibil ities of the express prohibition, in order to be able to eva l- uate the arguments in favor and against it, as well as the current alternatives that could achieve the intended objectives.
