Drones are remotely piloted aircrafts that have civil or military use. It is world-wide defunded and used technology that conquers space in Brazil to entertainment activities and also in public security activities. That way, this study has the objective to analyze the existence of legal backing in the use of drones in ostensive police activities and public order preservation in Brazil. Specifically, this article treated about technological innovation in police environment, bringing authors perspectives about the relevance of technological enhancement of police activity. In the sequel, it were introduced conceptualization, historical and classification of drones, bringing yet examples of its use in Brazilian public security. In the end, it was presented national legislation about the use of this technology, as which legal perspectives for the future. The research it was applied and by deductive method, being that, about the proposed objectives, it was exploratory, using bibliographical technique. It was concluded that, despite the use of this technology by a lot of police institutions, it is a subject that needs more approach by a specific legislation, that can reaches, in a objective way, the parameters of drones use in ostensive police activities and public order preservation.
