La congruencia flexible frente al control de convencionalidad

The work addressed the power of the criminal judge to vary the legal imputation referred to in the accusation when issuing a conviction, known as flexible congruence. To establish how flexible congruence is made effective in Colombia in compliance with inter-American obligations?, having as general objective to determine the forms of the effectiveness of said figure at the national level and its consequences within the framework of the American obligations interpreted by the Inter-American Court of Rights, which was approached and developed through qualitative, basic and legal research, using the analytical, deductive, dialectical and comparative method, focusing its analysis on the national and inter-American practice emanating from the Constitutional, Supreme Courts of Justice and Inter-American. Obtaining as a result that Colombia in an abstract and general way is complying with the inter-American standards enshrined in the American Convention on Human Rights, as well as those issued by the Inter-American Court, against the application of flexible congruence.
