For the State: A.P.P. ---------05/ 18.03.2015 The petitioners are accused in a case registered under Sections 341/323/324/307/34 of the Indian Penal Code in connection with Nagar Untari P.S. Case No. 115/2014, corresponding to G.R.No.1053/2014, pending in the Court of the S.D.J.M., Garhwa. There is allegation against the petitioners that they caused assault to the wife and the daughter of the informant by means of 'Garasa' (heavy sharp cutting weapon). The wife and the daughter of the informant had sustained injury on their person and one of the injury caused to wife of the informant is grievous in nature. It is submitted that the petitioners are languishing in jail custody for more than seven months and the incident took place on a petty cause of fetching water from hand pump. Counsel for the State has opposed the prayer. Since there is direct allegation against the petitioners that they caused assault to wife and daughter of the informant by means of 'Garasa', I do not feel inclined to release them on bail. Accordingly, prayer for bail made on their behalf stands rejected at present.
