Cómo afectan las nuevas formas de gestión del sistema sanitario español al personal sanitario

espanolLa evolucion normativa, nos ayuda a percatarnos de que la incorporacion de diferentes figuras de gestion al ordenamiento juridico no es tan reciente, se han venido utilizado desde los anos 90 la gestion indirecta en este sector. La normativa da plena legitimidad a la utilizacion de cualquier forma de gestion, esto es, que la prestacion y gestion de los servicios sanitarios podra llevarse a cabo, ademas de con medios propios de la Administracion, mediante acuerdos, convenios o contratos, con personas o entidades publicas o privadas, que estuvieran admitidas en Derecho y siempre garantizando y preservando su condicion de servicio publico. La Administracion Publica puede utilizar la forma de gestion que considere adecuada, sin incidir ni cambiar la naturaleza publica del servicio, no obstante, si existen diferencias de calado o sustantivas que pueden afectar a la gestion de los servicios. En relacion al regimen juridico sobre como afectan las nuevas formas de gestion al personal sanitario, realizaremos un estudio de las diferentes figuras del personal sanitario dependiendo del centro donde se integren para su actividad si el mismo esta gestionado en gestion directa, directa descentraliza o indirecta. Asi como, un caso especial, que provoca como hemos podido comprobar un perjuicio notable para el personal sanitario. Podemos advertir, que cuando se integra una gestion indirecta en un centro nuevo no provoca tanta problematica, sin embargo cuando se produce un cambio de gestion si. En estos casos, se genera un perjuicio al estatutario que debe optar por solicitar una excedencia especial y suscribirse con un contrato laboral para poder permanecer en el mismo centro, o bien solicitar un traslado (puede ser fuera del Area de Salud si no hubiera centro en gestion directa mas cercano), incluso advertimos la posibilidad de que si el mismo mantienen su excedencia podria perder su condicion de funcionarios con el tiempo. EnglishThe normative evolution, helps us to notice that the incorporation of different figures of management of the legal system is not so recent, they have come used from the 90s the indirect management in this sector. The regulation gives full legitimacy to the use of any form of management, this is, that the service and management of the health services will be able to carry out, in addition to with proper means of the Administration, through agreements, conventions or contracts, with persons or public or private entities, which were admitted into law and always guaranteeing and preserving its public service condition. The Public administration can use the form of management that was considered to be suitable, without affecting nor change the public nature of the service, nevertheless, openwork differences exist or substantive that can affect to the management of the services. As regards the legal system, on how do they affect the new forms of management of the sanitary personnel, we will realize a study of the different figures of the health personnel depending on the center where they integrate for its activity if the same one is managed indirect, direct management it decentralizes or innuendo. As well as, a special case, which it provokes as we could have verified a notable damage for the health personnel. We can warn, that when an indirect management integrates into a new center it does not provoke so much problems, nevertheless when a change of management takes place yes. In these cases, a damage is generated to the statutory staff who must choose to request a special leave and subscribe with a labor contract to be able to remain in the same center, or request a transfer (it can be out of the Area of Health if there was no more nearby center in direct management), we even warn the possibility of that if the same one they maintain its leave might lose its officials' condition with the time.
