REGULATION OF LABOR GENDER HARASSMENT IN MEXICO

Harassment is a phenomenon whose study with a gender perspective is important, as there are authors, such as Rodriguez, which indicate that, the total number of victims of this phenomenon the “78% are women” 1 . Despite the problems, the Mexican Labour Law introduces the topic until there form carried out in November of 2012, without considering any action with a gender perspective. It is important to emphasize that, the secondary laws and regulations, a follow up to the Article 1 constitutional give followup to the international human rights instruments duly ratified, as are: the Convention 11 of the ILO, the Convention on the Elimination of all Forms of Discrimination against Women, the International Covenant on Economic, Social and Cultural Rights, among others. However, the problem doesn’t yet have in Mexico a proper solution to the female victims, the solution put forward so far is of a general nature and is an important legal reform to meet the gender differences in labor and even more than effectively punishes to the stalkers and adequately protect the victims.
