PEMBERDAYAAN HUKUM TANAH: RESOLUSI ATAS KONFLIK TANAH MASYARAKAT MANGARAN KECAMATAN AJUNG KABUPATEN JEMBER

Land has a very strategic value in human life, both socially, politically and economically so that ownership is often accompanied by conflict. Mangaran land, for example, is a conflict between the state and the people who have occupied the area around the plantation since before independence’s day 1945. In the name of nationalization, the state takes over its ownership and utilization rights and is considered to deny the rights to the land of the people. There are two patterns of Mangaran land conflict, first, vertical conflict between Mangaran community and PTPN XII with the trigger of land tenure on behalf of the state. Second, horizontal conflicts among community members due to inheritance, land boundaries and property rights have triggered disruption of social harmony of Mangaran community.
