¿Existe un conflicto armado interno en México según el Derecho Internacional? Los Convenios de Ginebra y su aplicación a la Guerra contra el narcotráfico (2006-2012)

2016
To mark a decade since the former President Felipe Calderon (2006-2012) declared the War on Drugs in Mexico, this paper analyzes the relevance of classifying that confrontation as an internal armed conflict under the standards of International Law. It arises as a hypothesis that the confrontation developed into Mexican territory doesn’t cover the parameters established for the existence of a non-international armed conflict under International Humanitarian Law, qualifying more as Others Situations of Violence in accordance with the terminology proposed by the International Committee of the Red Cross, setting that is not contemplated in international jurisdiction.
