Estudio de caso: trastorno de estrés postraumático y capacidades parentales en una víctima de violencia de género

espanolLa Ley Organica 1/2004 de Medidas de Proteccion Integral contra la Violencia de Genero ha reformado el ordenamiento juridico vigente con el objetivo de dar respuesta al problema social que supone la violencia ejercida contra la mujer en el contexto de la pareja. Para ello, ha reforzado la figura del psicologo forense tanto en la jurisdiccion penal como civil. En el presente articulo se expone el estudio de caso de una victima de violencia de genero con un diagnostico de Trastorno de Estres Postraumatico. Se profundiza en la metodologia de evaluacion y en los aspectos tecnicos mas importantes a tener en cuenta. En este caso, desde un prisma victimologico, la labor del psicologo forense consiste en evaluar el dano psiquico, lo que implica valorar la potencialidad traumatica del estresor (determinar el tipo de violencia) y establecer la relacion causal con la lesion psiquica (huella psicopatologia del delito). En materia civil, el psicologo forense valorara si el impacto de la violencia en la victima interfiere en sus capacidades parentales. EnglishOrganic Law 1/2004 on Protection against Gender-Based Violence has changed the existing legal order to address the social problem of violence against women within the context of the partnership. To this purpose, it hasreinforced the role of the forensic psychologist in both criminal and civil jurisdictions. This article provides a case study of a victim of gender-based violence diagnosed with Post-Traumatic Stress Disorder. The assessment methods and the most important technical considerations are discussed in further detail. In this case, from a victimological standpoint, the task of the forensic psychologist is to assess the psychological impact, which implies evaluating the traumatic potential of the stressor (establishing the type of violence) and setting up the causal correlation with the psychological impact (psychopathological imprint of the violence). In civil matters, the forensic psychologist will assess whether the impact of the violence against the victim interferes with his or her parental capacities.
