The doctrine of the presumption of innocence is a principle of criminal action that is generally recognized and established by the modern legal nations, and is defined by the Article 12 of 《The Criminal Procedure Law of The People's Republic of China》, and its contents lay a foundation for the lawyers' defense. The doctrine of the presumption of innocence also reflects a kind of common safeguarding to the human rights of the citizens, thus providing the nation a more generous, civilized and humane social political condition for the criminal suspect and the defendant as well as a theoretical atmosphere for the lawyers' good practice. This is conducive to the lawyers' defense, which would be made more practical and effective.
