The following research allows us to know the importance of evaluating the evidence of maintenance proceedings based on sound criticism considering that is the most important activity performed by judges towards of a decision for the benefit of children and adolescents. Within this thesis we are known how the maintenance proceedings is developed in Ecuador, the same one that begins with the demand, subsequently its qualification. The conciliation hearing and the request to ultimately stablished a payment of alimony, the parties have the option to contest the case, as we can see this is a quite expeditious process. In this kind of processes the parities always respecting the due process and the principles recognised in various legal bodies who can demostrate their claims and excmeptions that arise both in the demand and reply and for that our legislation jointly with the doctrine gives us the different kinds of evidences among them are; The documentary evidence consisting of the declaration of will or knowledge in writing, oral evidence, which is based on the statement made by a person on the truth of a fact that has knowledge, material evidence that is appreciated by the judge through their five senses having a direct relationship with the material things of litigation. This research indicates in assessing the evidence made by the judge on the evidence supporting which have reached out and present the litigants, during the maintenenace proceedings , keeping in mind this kind of process should be fast, as provide the Code of Children and Adolescents, that means to resolve speedily.
