Teletrabajo y prevención de riesgos laborales: un reto jurídico a desarrollar más allá de la actual legislación post Covid-19

espanolEl objetivo de este estudio es ofrecer una propuesta unificada de las fases o rutinas preventivas en el teletrabajo independientemente del regimen profesional en el que este se desarrolle. Ello supone superar la actual legislacion post Covid-19. Para llegar a dicha conclusion, en primer lugar, se lleva a cabo un analisis de las distintas regulaciones vigentes en Espana en materia de teletrabajo, con el fin de determinar el ambito de aplicacion personal y material de las mismas. Precisamente, ello constituira el fundamento para demostrar que, en funcion de la regulacion aplicable, cabe para cada sujeto una situacion diferente en materia de prevencion de riesgos laborales. Para ello se ofrece una vision global y critica de la regulacion objetiva sobre la prevencion de riesgos laborales dentro de lo que hemos denominado marco normativo basico aplicable al teletrabajo. En ultimo termino, la propuesta que se presenta en torno a las fases o rutinas preventivas en el teletrabajo pretende responder a las cuestiones planteadas previamente y solventar las incongruencias y lagunas detectadas tras el profundo estudio llevado a cabo de la principal normativa tanto estatal como autonomica. Precisamente, a nuestro entender, en ello reside el reto juridico a desarrollar mas alla de la actual legislacion post Covid-19. EnglishThe purpose of this work is to provide a unified proposal of prevention stages or routines regarding telework, regardless of the professional regime where it takes place. This implies overcoming the current post Covid-19 legislation. To that end, first, we will analyse the different regulations in Spain in terms of telework, in order to determine their personal and material scope of application. In fact, this will be the basis to prove that, according to the applicable regulation, each subject will have a different situation in terms of occupational risk prevention. For that purpose, we will offer a global and critical view of the regulation about occupational risk prevention within the basic legal framework applicable to telework. Ultimately, our proposal about prevention stages or routines regarding telework aims to give an answer to the abovementioned issues and resolve the contradictions and gaps detected after the deep analysis of the main legislation. In fact, there we can find the main legal challenge to develop beyond the current post Covid-19 legislation.
