Comentarios al Anteproyecto Ley de Eficacia Procesal

espanolEl ministerio de justicia prepara en 2021 una reforma en profundidad del sistema de justicia espanol, excesivamente anclado en unas estructuras propias de la sociedad rural del siglo XIX y que, a pesar del incremento del numero de jueces e inversiones en edificios y medios materiales, no ha conseguido el minimo de eficacia que debe tener para ofrecer a la ciudadania un servicio publico eficaz. Con una fuerte resistencia al cambio desde los operadores juridicos, ha elaborado dos proyectos importantes en materia civil, con el objetivo de promover la eficacia procesal y la eficacia organizativa. Su proxima y esperada tramitacion parlamentaria puede suponer un salto cualitativo para superar un modelo obsoleto. En este articulo se analiza la insercion de los MASC (medios adecuados para la resolucion de controversias) como actividad negocial obligatoria que servira de filtro para el acceso al proceso judicial. EnglishThe Ministry of Justice is preparing in 2021 an in‐depth reform of the Spanish justice system, that is over‐anchored in structures typical of rural society in the 19th century and which, despite the increase in the number of judges and the investments in buildings and material means, has not achieved the minimum efficiency required to offer citizens an effective public service. With a strong resistance to change from legal operators, it has developed two important projects in the civil sphere, aimed to promote the procedural efficiency and the organizational effectiveness. Its forthcoming and long‐awaited parliamentary process may mean a qualitative leap to overcome an obsolete model. This article assesses the insertion of the MASC (appropriate means for dispute resolution) as a mandatory negotiating activity that will serve as a filter for access to judicial process. Always in matters of free autonomy of the parties, and with the exception of matters of public policy.
