In this paper titling the overall objective proposed by the researchers was to determine whether an error was made by the judge in the 0033-2012 judicial proceedings conducted in Civil Multicompetente Unit based in El Guabo Canton, which substantiated the cause, when setting alimony, visitation and possession in the operative part of a judgment of divorce causal process which in the main is declared without. The main discussion of the research was conducted on the issue of due process to establish alimony in a divorce, is this mutual or litigation, the effect caused by the lack of agreement of the parties regarding minors, and finally the content of the resolution if the causal has not been demonstrated as far as divorce is concerned.
