The Regime of Separation of Property (Regimul Separaţiei De Bunuri)

English Abstract:In the current regulation of the Civil code, under the regime of separation of property the spouses may have only two classes of assets: own assets and assets tenancy-in-common.The regime of separation of property shall ensure to each of the spouses an exclusive property right both in terms of assets acquired before the marriage, as well as in respect of the assets that they purchase on his own behalf during the marriage. Also under the regime of separation of property debts assumed by each of the spouses are personal, except those arising out of either of them to cover the costs of marriage and those related to the growth and education of the children for whom spouses are jointly responsible.Under the separation of property each spouse administers, uses and disposes of sole proprietorship assets in a discretionary way, with no interference from the other side.Romanian Abstract: In actuala reglementare a Codului civil, sub regimul separaţiei de bunuri soţii pot avea numai două categorii de bunuri: bunuri proprii si bunuri proprietate comună pe cote-părţi.Regimul separaţiei de bunuri asigură fiecăruia dintre soţi un drept de proprietate exclusivă atât in privinţa bunurilor dobândite inainte de incheierea căsătoriei, precum si in ceea ce priveste bunurile pe care le achiziţionează in nume propriu in timpul căsătoriei. De asemenea, sub regimul separaţiei de bunuri datoriile asumate de fiecare dintre soţi sunt personale, excepţie făcând cele asumate de oricare dintre acestia pentru acoperirea cheltuielilor obisnuite ale căsătoriei si a celor legate de cresterea si educarea copiilor pentru care soţii răspund solidar.In cadrul regimului separaţiei de bunuri fiecare dintre soţi administrează, foloseste si dispune in mod discreţionar de bunurile proprietate exclusivă, fără nicio ingerinţă din partea celuilalt.
