Публикуемый обзор очередных пленарных сессий Европейской комиссии за демократию через право (Венецианской комиссии) требует комментария редакции.Впервые со времени вступления России в Венецианскую комиссию (январь 2002 г.) российские представители не участвовали в работе пленарной сессии.И хотя Комитет министров Совета Европы принял решение о прекращении членства России в Венецианской комиссии 22 марта 2022 г. (в нарушение Расширенного соглашения 2002 г., давшего возможность государствам, не являющимся членами Совета Европы, быть полноправными членами Венецианской комиссии), российские представители еще до принятия этого решения не получили традиционного уведомления (Convocation) и координаты Zoom для онлайн-участия в заседании 130-й пленарной сессии, состоявшейся 18-19 марта 2022 г.Таким образом, новым руководством Комиссии были нарушены как Регламент Комиссии, так и принципы демократии и права, лежащие в основе деятельности Венецианской комиссии.Тем не менее Журнал зарубежного законодательства и

The article analyses a so called “evolutive interpretation” of the European Convention on Human Rights by the European Court of Human Rights creating its case-law. Doing so the Court as a subject of this interpretation has a legitimate competence in the light of the Article 32 of the Convention. The problem is how wide could be this interpretation taking in account the principle of subsidiarity of the european system of the protection of human rights and doctrine of the “margin of appreciation” of the contracting States.

The Institute of legislation and comparative law under the Government of the Russian Federation, as the organizer of The international Congress of comparative law in partnership with the European Commission for democracy through law (the Venice Commission of the Council of Europe), seeks to attract representatives of various legal systems, schools, and generations to cooperate. It is as a result of such cooperation that it is possible to get the most adequate picture of the modern legal world. The topic of the IX Congress was chosen as the problem of value orientations in various branches of law, since in the field of comparative legal research it is often the starting point of scientific research. The purpose of this publication is to enrich the methodology of comparative legal research, fill in theoretical developments and help in the implementation of practical tasks of jurisprudence, which are set by modern society. The materials of the collection convincingly show the importance of socially significant values for increasing the effectiveness of legal regulation in various areas of public and state life. For practicing lawyers, employees of public authorities, representatives of the scientific community, teachers, students and postgraduates of law schools and faculties, as well as for anyone interested in the value sources of law and legislation.

Аннотация.Рассматривается методология коллективных сравнительно-правовых исследований, которые осуществляет Европейская комиссия за демократию через право (Венецианская комиссия) в условиях «расширенного соглашения».Превратившись из узкого круга экспертов европейских государств в транснациональный конституционный форум, Венецианская комиссия ставит задачу разработать подход, основанный на универсальных ценностях.Лишь в случае успешного достижения такой задачи Венецианская комиссия сможет и далее осуществлять свою главную цель -продвигать и развивать идею демократии через право.Одним из главных инструментов на этом пути являются сравнительно-правовые исследования.В статье последовательно рассматриваются основания для применения сравнительно-правового метода в актах Венецианской комиссии, характерные черты практики проводимых сравнительно-правовых исследований и основные их методы -догматический, функциональный, контекстный и исторический.Отдельно авторы исследуют проблематику недостаточного
